Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Stampiyaan (“Stampiyaan”, “we”, “us”, “our”), the operator of the Stampiyaan digital loyalty-card platform (the “Service”), with offices at 16-S Gulberg Center, Lahore, Pakistan. By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy and Refund & Cancellation Policy, which are incorporated by reference. If you do not agree, do not use the Service.
If you accept these Terms on behalf of a business, you represent that you are authorised to bind that business. In these Terms, that business is the “Account Holder”, a person who signs up for a loyalty card at an Account Holder’s café is a “Customer”, and “Personal Data” means information relating to an identified or identifiable individual.
1. The Service
Stampiyaan lets cafés and similar businesses run digital loyalty cards delivered through Apple Wallet, Google Wallet and a web card. The Service includes customer sign-up via QR, staff scanning to award stamps and redeem rewards, an owner dashboard, multi-branch management, wallet broadcast messaging, and related features we may add, change or remove over time.
2. Eligibility and accounts
You must be at least 18 years old and capable of forming a binding contract to use the Service. You agree to provide accurate, current information and to keep it up to date.
You are responsible for safeguarding your login credentials and any staff scan passwords, and for all activity that occurs under your account or branches, whether or not authorised by you. Notify us promptly of any unauthorised use or security incident. We are not liable for losses arising from your failure to keep credentials secure.
3. Account Holder responsibilities and Customer data
As between you and Stampiyaan, the Account Holder is the data controller of its Customers’ Personal Data and determines the purposes for which it is collected and used. Stampiyaan acts as a data processor and processes that Personal Data only to provide the Service and on the Account Holder’s documented instructions, as described in our Privacy Policy.
You are solely responsible for: (a) having a valid lawful basis and, where required, the consent of each Customer to collect their data and to contact them; (b) providing your Customers with your own privacy notice; (c) the accuracy and content of the data you upload or collect; and (d) honouring your Customers’ data-protection rights, for which the Service provides export and deletion tools.
4. Acceptable use
You agree not to, and not to permit anyone to:
- use the Service for any unlawful, fraudulent, deceptive, infringing, defamatory, obscene or harmful purpose;
- send spam or unsolicited messages, or message any person who has not consented to be contacted through your loyalty programme;
- upload or transmit malware, or anything that violates the privacy or intellectual-property rights of others;
- harvest, scrape, or bulk-export data except through features we provide, or use the Service to build a competing product;
- reverse engineer, decompile, disassemble, or attempt to derive source code, except to the extent this restriction is prohibited by law;
- probe, scan, or test the vulnerability of the Service, breach or circumvent authentication, rate limits, or other security or usage controls;
- interfere with or disrupt the Service, place undue load on it, or attempt to gain unauthorised access to any account, system or data;
- impersonate any person or misrepresent your affiliation, or resell, sublicense or share access without our written permission.
We may investigate suspected misuse and cooperate with law-enforcement. We may remove content and suspend or terminate access for conduct we reasonably believe breaches these Terms or the law, with or without notice where the breach is serious or ongoing.
5. Wallet messaging and anti-spam
Broadcasts and other messages you send to cardholders must be lawful, relevant, and sent only to Customers who have agreed to receive them. You are responsible for message content and for complying with applicable law, including the Prevention of Electronic Crimes Act 2016 and any rules on unsolicited communications. We may apply rate limits and may suspend messaging that we reasonably believe is abusive, unlawful, or harmful to recipients or to wallet providers.
6. Plans, fees and billing
Paid plans, custom plans and branch add-ons (charged at ₨1,500 per branch per month) are billed in advance for the cycle you choose — monthly, or annually with two months free. Fees are stated exclusive of any applicable taxes, which are your responsibility. Plans renew automatically until cancelled.
Payment is made via JazzCash, Easypaisa or bank transfer; we do not accept or store card details. Invoices are issued to your account. If payment is not received by the due date, we may suspend or restrict the Service after a reasonable grace period. We may change prices or plan features on prospective notice; changes take effect from your next billing cycle.
7. Intellectual property
The Service, including its software, design, trademarks and content (excluding your content and your Customer data), is owned by Stampiyaan and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your business during your subscription.
You retain all rights to your content and your Customer data. You grant us a licence to host, process and display that content solely to operate and improve the Service. If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them without obligation to you.
8. Third-party services
The Service relies on third parties, including Apple Wallet, Google Wallet, hosting providers, and payment channels. Your and your Customers’ use of wallet passes is also subject to Apple’s and Google’s terms. We are not responsible for third-party services, their availability, or changes they make, and their acts or omissions are outside our control.
9. Availability and changes to the Service
The Service is provided on an “as is” and “as available” basis. We aim for high availability but do not guarantee uninterrupted or error-free operation, and we may carry out maintenance, modify, suspend, or discontinue features at our discretion. We will use reasonable efforts to give notice of material adverse changes.
10. Suspension and termination
You may stop using the Service and cancel at any time, as described in our Refund & Cancellation Policy. We may suspend or terminate your access for breach of these Terms, non-payment, legal requirements, or risk to the Service or others. On termination, your right to use the Service ends; you will have a reasonable window to export your data, after which we may delete it in line with our Privacy Policy. Sections that by their nature should survive termination will do so.
11. Disclaimers
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, that loyalty or marketing activity will produce any particular result, or that wallet passes will always be deliverable on every device.
12. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill, or data. Our total aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the three (3) months immediately before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.
13. Indemnity
You will defend, indemnify and hold harmless Stampiyaan and its personnel from and against any claims, damages, losses and expenses (including reasonable legal fees) arising out of or related to: your content; your Customers’ Personal Data and your handling of it; your use or misuse of the Service; messages you send; or your breach of these Terms or of any applicable law.
14. Confidentiality
Each party may receive non-public information of the other. The receiving party will protect it with reasonable care and use it only to perform under these Terms, except where disclosure is required by law.
15. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms with a new “Last updated” date and, for material changes, take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance.
16. General
These Terms are governed by the laws of Pakistan, and the courts of Lahore have exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer protections. If any provision is held unenforceable, the rest remains in effect. These Terms (with the policies referenced) are the entire agreement between us on this subject. We may assign these Terms in connection with a merger, acquisition or sale of assets; you may not assign them without our consent. Our failure to enforce a provision is not a waiver. Neither party is liable for delays or failures caused by events beyond its reasonable control (force majeure). Notices to you may be given through the Service or your account email.
